Agility's framing of Digit 5 as 'safety-conscious' is a design claim, not a compliance claim. The announcement doesn't specify which safety standards the robot meets, which third-party certifications it holds, or what happens if it fails in a human-occupied space. That gap matters because 'designed for' collaborative environments is not the same as 'approved for' them.

This launch arrives as the industry is beginning to embed external oversight into AI development, per Anthropic and OpenAI's recent move to place independent safety evaluators inside their labs. But Digit 5 represents the inverse problem: physical systems deployed into the real world without equivalent structural accountability. The robotics sector lacks the embedded evaluator model entirely. Agility's announcement suggests the company is betting that design-level safety thinking substitutes for regulatory teeth, which is precisely the voluntary framework the AI labs are now moving past.

If Agility publishes third-party safety audit results or submits Digit 5 to NIST or ISO certification before the first commercial deployment, that signals genuine commitment to external validation. If deployment proceeds without published external assessment, the 'safety-conscious' claim remains marketing language without institutional backing.
